Adopted State Child Care Licensing Regulations
Regulations R112-06 and R032-07 Adopted as of April 23, 2009!
The Bureau of Services for Child Care recently sent a letter informing all child care providers in the State of Nevada of the adoption of the R112-06 and R032-07 regulations of Chapter 432A of the administrative code of Nevada as issued by the Secretary of State on April 23, 2009. The Bureau will begin monitoring compliance of these regulations on April 1, 2010 unless otherwise noted in the provisions.

R001-09 Proposed Regulation Update

The R001-09 proposed regulation document did not pass in the latest Legislative Commission meeting held April 22, 2009. The R001-09 document, which includes Ratios/Group size and Director Qualification sections, needs to be heard in front of the Board for Child Care before going back to the Commission again. Some of the effective dates with the document were changed. At this time the Bureau of Services is working on filling board member slots and once that is complete an Adoption Hearing will be held, TBA.

432A Proposed Regulation Update

The Legislative Commission met again on Wednesday, April 22, 2009 to hear the 432A proposed regulations. Documents R032-07 and R112-06 were passed. Congratulations to everyone who worked so hard on these! The new document R001-09 was not passed, which included ratios, group size and director qualifications. The next Legislative Commission meeting will be held in May - the schedule has not yet been posted. There will be discussion as to the next steps in the proposals of the LCB File No. R001-09 document in the next week.
Attention! The 432A proposed regulations are scheduled to be heard by the Legislative Commission on April 22, 2009 at 4:00 pm.
Previous correspondence provided by the Bureau of Services for Child Care indicated that the R112-06, R032-07, and the new '09 proposed regulation document had to be heard by the Board for Child Care before the proposals could return to the Legislative Commission. However, since the third document (’09) will keep the same language that was in the original '07 document regarding ratios, group size, and director qualifications, the Board for Child Care will not have to adopt again.
A NEW UPDATE ON THE PROPOSED REGULATIONS
Information previously provided by the Bureau of Services for Child Care indicated that the R112-06 document had passed, however, due to some confusion with the Legislative Commission meeting, they decided to hold the R112-06 document and not go forward with adoption. There will now be 3 separate documents; R112-06, R032-07 and a new document that does not have a LCB file number at this time. Sections 10, 11, 21 and 22* will be taken out of the R032-07 document and added to a third document. The third document (new) will include sections 10, 11, 21 and 22 and any other provisions that relate to those sections. These sections will have new phase-in periods. The next steps will include another Adoption Hearing held by the Board for Child Care and then a re-submission to the Legislative Commission.

Update to Proposed Regulation Changes
On Tuesday, February 10th, the 432A proposed regulations were heard at the Legislative Commission meeting. The R112-06 document passed. However, R032-07 did not pass. The Bureau of Child Care Services will be returning to the Legislative Commission within 30 to 45 days to re-submit R032-07 document without sections 11, 21 and 22 (Director Qualifications, ratios and group size). A new LCB document will then be created with just those 3 sections (11, 21 and 22). The Bureau will put a new phase in period for sections 11, 21 and 22 and then resubmit for another Adoption Hearing through the Board for Child Care.
